Phase 1 P3 Agreement

BPW Approval

On August 11, 2021, in accordance with Maryland law, MDOT and MDTA presented to and received approval from the Board of Public Works to award the Phase 1 P3 Agreement to Accelerate Maryland Partners, Inc. for the predevelopment work related to Phase 1 of Op Lanes Maryland, known as the New American Legion Bridge I-270 Traffic Relief Plan (the “Project”).

In accordance with the terms and conditions of the Phase 1 P3 Agreement, MDOT and the Phase Developer will further advance predevelopment work on the first section, which includes from the vicinity of the George Washington Memorial Parkway across the American Legion Bridge to I-270 and on I-270 up to I-370, ("Phase 1 South").


Legislative Report

As required by Maryland law, the Maryland Department of Transportation (MDOT) and the Maryland Transportation Authority (MDTA), together as the "Reporting Agencies," submitted a proposed Phase 1 P3 Agreement for Phase 1: New American Legion Bridge to I-270 Traffic Relief Plan to the Comptroller, the State Treasurer, the Budget Committees, and the Department of Legislative Services prior to seeking approval from the Maryland Board of Public Works.

Under the Annotated Code of Maryland State Finance § 10A-203, the Comptroller, State Treasurer, Budget Committees, and the Department of Legislative Services have up to 30 days from the date of submission to review, analyze, and comment on the Phase 1 P3 Agreement.  As also required by the law, the proposed Phase 1 P3 Agreement is posted on this website to allow public review of the documents during the 30-day review period as well.

In addition to submitting the proposed Phase 1 P3 Agreement for review and comment, a Final Report on the Phase 1 P3 Agreement is required to be submitted in accordance with the Code of Maryland Regulations 11.01.17.09(J) and 11.07.06.09(J). This Report provides background into Phase 1, information on the rationale for utilizing a P3 delivery method, and the methodology used in the solicitation and selection of the Phase 1 developer.  The report also discusses key elements of the Phase 1 P3 Agreement, the financial plan, tolling operations, the National Environmental Policy Act activities, and updates to previously defined Board of Public Work commitments.
